Please review these policies carefully as they are the terms of sale that govern your purchases at the Torokhtiy Store. They set out your rights and obligations with respect to your purchases.

1. PARTIES AND SCOPE

In consideration of being allowed to purchase, access, use, or participate in any products, services, content, or activities offered by TORWOD LLC (“TORWOD,” “we,” “us”), you agree to this Agreement and Release of Liability (“Agreement”).

This Agreement applies to:

– All TORWOD websites and subdomains, including torokhtiy.com, store.torokhtiy.com, programs.torokhtiy.com, and any other torokhtiy.com subdomain (the “Service”);

– Any digital products (including PDFs, downloads, training programs, educational materials, videos and any digital access or services we provide);

– Any subscription or membership services, including Torokhtiy Club;

– Any coaching, feedback, recommendations, communication, community features, and support provided online;

– Any offline events (seminars, camps, workshops, meetups) where TORWOD or any Released Party is coaching, presenting, leading, or otherwise participating, whether the event is hosted by TORWOD or by a third-party organizer/venue;

– Any physical products you purchase from us (apparel, merchandise, accessories), including their use.

Some services or content may be delivered through third-party platforms (for example, training platforms, payment providers, community tools, email/SMS providers, or video hosting). This Agreement still applies to your participation in TORWOD activities and use of TORWOD products and content, regardless of the delivery method.

2. ASSUMPTION OF RISK

You understand and acknowledge that strength training, weightlifting, conditioning, mobility, stretching, and other fitness activities can be hazardous and involve risks including, but not limited to: muscle strains, sprains, fractures, heart or cardiovascular events, illness, serious injury, paralysis, and death.

You voluntarily choose to participate in these activities and/or use TORWOD programs and content with full knowledge of the risks. You expressly assume all risks of injury, illness, or death related to your participation, whether known or unknown, foreseeable or unforeseeable.

3. HEALTH ACKNOWLEDGMENT / NOT MEDICAL ADVICE

You represent that you are at least 18 years old.

You acknowledge that TORWOD has recommended that you obtain medical clearance from a physician before beginning any exercise or nutrition changes. You acknowledge that TORWOD content and services are educational and are not medical advice, diagnosis, or treatment. You agree that you are solely responsible for your health decisions, participation, and outcomes.

If you choose to participate without medical clearance, you assume full responsibility for that decision. You confirm that you meet all stated requirements to purchase, access, or use the product/service and that any information you provide is accurate and complete. TORWOD is not responsible for issues caused by inaccurate/incomplete information or failure to follow stated requirements and instructions, to the fullest extent permitted by law.

4. RELEASE OF LIABILITY / WAIVER OF CLAIMS

To the fullest extent permitted by law, you hereby waive, release, and forever discharge TORWOD LLC and its affiliates, related entities, brand owners, officers, directors, employees, contractors, coaches, consultants, agents, volunteers, successors, and assigns (the “Released Parties”) from any and all claims, demands, causes of action, damages, liabilities, costs, or expenses (including attorney fees) arising from or related to:

– Your purchase, access, use, or participation in any TORWOD products, services, content, training programs, coaching, community features, or activities (online or offline);

– Any injury, illness, disability, death, or property damage you may suffer in connection with the above;

– Your use or misuse of equipment, facilities, or any training method described in TORWOD materials.

This release includes claims arising from the ordinary negligence of the Released Parties, to the fullest extent permitted by law, but does not include claims that cannot be waived under applicable law (for example, gross negligence or willful misconduct where prohibited).

5. PHYSICAL PRODUCTS (USE AT YOUR OWN RISK)

If you purchase or use physical products sold by TORWOD, you acknowledge that:

  • You are responsible for selecting appropriate products and using them safely and as intended;
  • Any training-related use of physical products is at your own risk;
  • TORWOD is not responsible for injuries caused by improper use, misuse, modification, failure to follow care/use instructions, or use outside intended purposes.

Nothing in this section limits any rights that cannot be waived under applicable law for physical goods.

6. THIRD-PARTY PLATFORMS AND EXTERNAL SERVICES

You understand that TORWOD may use third-party platforms to deliver services (for example: training delivery platforms such as TrainHeroic, SugarWOD or any other, community tools, video hosting, analytics, or payment processors). These third parties may have their own terms, privacy policies, and service availability.

To the fullest extent permitted by law, TORWOD is not responsible for third-party platform outages, interruptions, technical issues, or third-party acts/omissions. Your use of third-party platforms is at your own risk and subject to their terms.

7. NO GUARANTEED RESULTS / NOT INDIVIDUALIZED SERVICES

You understand that results are not guaranteed and depend on many factors (training history, recovery, nutrition, consistency, sleep, stress, genetics, and adherence). Unless explicitly stated in writing, you are not purchasing individualized medical services or individualized 1:1 coaching, and TORWOD has no obligation to provide individualized answers or modifications beyond what is included in the product/service description.

8. INDEMNIFICATION / HOLD HARMLESS

To the fullest extent permitted by law, you agree to indemnify and hold harmless the Released Parties from any claims, damages, liabilities, costs, or expenses (including attorney fees) arising from your actions, your participation, your violation of these terms, or your misuse of TORWOD products/services, including claims brought by third parties.

9. SEVERABILITY AND ACCEPTANCE

If any part of this Agreement is found unenforceable, the remaining portions will remain in full force and effect.

By purchasing, accessing, using, or participating in TORWOD products, services, or activities, you acknowledge that you have read, understood, and voluntarily agree to this Agreement.

1. GENERAL TERMS

These Terms and Conditions (“Terms”) govern your access to and use of the TORWOD LLC services and websites (the “Service”), operated by TORWOD LLC (“TORWOD,” “we,” “us,” “our”), 30 N Gould ST STE 5117, Sheridan, Wyoming, USA 82801.

SCOPE OF THE SERVICE

These Terms apply to any website, store, checkout, or digital delivery page operated under the torokhtiy.com domain, including torokhtiy.com, store.torokhtiy.com, programs.torokhtiy.com, and any other torokhtiy.com subdomain.

Some content or services may be delivered through third-party platforms (for example: training delivery platforms such as TrainHeroic or SugarWOD, payment providers, community tools, video hosting, analytics, or email/SMS providers). These Terms still apply to your purchase and use of TORWOD products and services, regardless of the delivery method. Your use of third-party platforms may also be subject to their own terms and policies.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICE.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

By accessing or using the Service, creating an account, placing an order, subscribing, downloading, or otherwise using any TORWOD product or service, you agree to be bound by these Terms and the policies incorporated by reference below. If you disagree with any part of these Terms, do not use the Service.

2. VALIDITY OF CONTRACT, PRODUCT AND PRICE INFORMATION

These Terms apply to purchases of products and services from the Service, including digital content (training programs, PDFs, downloads, and video access), subscriptions/memberships (including Torokhtiy Club or other subscriptions), offline events (tickets/registrations), and physical merchandise.

The prices of products and services sold on the Service are indicated next to the products/services and are subject to change at any time.

Product information is provided adjacent to the product/service in the online store. We strive to display accurate information but do not guarantee that descriptions, images, specifications, and availability are error-free.

ELIGIBILITY AND ACCURATE INFORMATION

By purchasing, accessing, using, or participating in any TORWOD product, service, or event, you confirm that you meet any stated eligibility requirements (including age requirements) and that information you provide is accurate, complete, and not misleading. To the fullest extent permitted by law, TORWOD is not responsible for issues arising from inaccurate, incomplete, or omitted information you provide or from failure to meet stated requirements or follow instructions.

3. PAYMENT

We accept payments through Visa, Mastercard, bank transfer, PayPal, and other methods shown at checkout.

You represent and warrant that:

  1. you have the legal right to use any payment method used in connection with a purchase; and
  2. the information you supply to us is true, correct, and complete.

By submitting payment information, you grant us the right to provide information to third parties (such as payment processors) for purposes of completing purchases.

We reserve the right to refuse or cancel orders at any time for reasons including, but not limited to: product/service availability, errors in description or price, errors in your order, suspected fraud, or unauthorized/illegal transactions.


CURRENCY

Prices on the Service may be displayed in different currencies based on your selection and/or location for your convenience. Currency conversions, rounding, and price formatting may be provided by third-party tools or platforms and can change over time.

The currency you are charged in will be clearly shown at checkout before you complete payment. If your payment method uses a different currency, your bank or card provider may apply currency conversion and additional fees (including foreign transaction fees). TORWOD is not responsible for exchange-rate fluctuations, rounding differences, or fees charged by third parties.

4. DIGITAL PRODUCTS (PDFs, DOWNLOADS, VIDEO ACCESS, DIGITAL SERVICES)

DELIVERY AND ACCESS

Digital products may be delivered immediately after purchase by download, email, account access, or via third-party platforms. You are responsible for maintaining access to the email/account you used at checkout.

COMPATIBILITY

You are responsible for ensuring your device, software, and settings can access the digital product (PDF readers, apps, platform access, etc.). TORWOD is not responsible for limitations caused by your device, settings, or third-party software/platforms.

LICENSE AND RESTRICTIONS

Unless explicitly stated otherwise in writing, TORWOD digital products are licensed to you for personal, non-commercial use. You may not copy, share, resell, redistribute, publicly post, or otherwise distribute TORWOD digital content.

DIGITAL PRODUCTS REFUNDS

Digital purchases are governed by the Digital Products Refund Policy. If you offer a 30-day money-back guarantee, refund requests must be made within 30 days from the order date following the process stated in that policy.

5. SUBSCRIPTIONS / MEMBERSHIPS (INCLUDING TOROKHTIY CLUB)

If you purchase a subscription or membership, you authorize recurring billing at the price and frequency shown at checkout until you cancel.

CANCELLATION

You can cancel a subscription according to the instructions provided in your account or as described at checkout. Cancellation stops future renewals but does not retroactively refund amounts already paid unless required by law or explicitly stated in the applicable refund policy.

PRICE CHANGES

We may change subscription pricing. If required, we will provide notice before the change applies to your next billing cycle.

FAILED PAYMENTS

If a payment fails, we may retry the charge and/or suspend access until payment is successful.

6. PHYSICAL PRODUCTS (APPAREL, MERCHANDISE, ACCESSORIES)

Some physical products may be made-to-order and fulfilled through print-on-demand providers (for example, Printful). Production and shipping timelines may vary by product and destination.

SHIPPING AND CUSTOMS

Shipping costs and estimated delivery windows are shown at checkout and/or on product pages. International customers are responsible for customs duties, taxes, and fees required by their country.

PHYSICAL PRODUCT RETURNS

Physical products are governed by the Physical Products Refund & Returns Policy.

7. OFFLINE EVENTS (SEMINARS, CAMPS, WORKSHOPS)

Offline event purchases (tickets/registrations) are ruled by Offline Events Liability Waiver.

You may be required to agree to additional event terms, venue rules, and/or sign a separate waiver at or before the event.

Event details (location, schedule, speakers) may change. If an event is rescheduled, your ticket may remain valid for the new date, subject to the event policy.

8. PRICING, AVAILABILITY, ERRORS AND INACCURACIES

We constantly update our offerings. Products/services may be mispriced, described inaccurately, or unavailable, and information may change without notice. We reserve the right to correct errors, inaccuracies, or omissions at any time.

9. CONTESTS, SWEEPSTAKES AND PROMOTIONS

From time to time, TORWOD may offer promotions, discounts, coupon codes, bundles, limited-time pricing, gifts, or other special offers (“Promotions”).

Unless separate written rules are published for a specific Promotion, all Promotions are governed by these Terms.

Promotions may change, pause, or end at any time, may be limited by time, quantity, product, or customer eligibility, and are valid only while they are accepted and applied at checkout.

Unless explicitly stated otherwise, Promotions cannot be combined with other discounts, coupon codes, bundles, affiliate offers, or previous/expired offers.

The final price and any discount that applies to your order is the one shown and successfully applied at checkout at the time you place the order. We do not retroactively apply Promotions, match prior offers, or combine multiple discounts after purchase.

If a Promotion is applied in error or outside its intended scope, we reserve the right to cancel or adjust the order to the extent permitted by law.

10. ACCOUNTS

If you create an account, you must provide accurate and current information. You are responsible for safeguarding your password and all activity under your account. Notify us immediately of any unauthorized use or security breach.

11. INTELLECTUAL PROPERTY

The Service and its original content, features, and functionality are the exclusive property of TORWOD LLC and its licensors and are protected by copyright, trademark, and other laws. You may not use our trademarks or trade dress without prior written consent.

12. LINKS TO OTHER WEBSITES

The Service may contain links to third-party websites or services not owned or controlled by TORWOD. We assume no responsibility for third-party content, privacy policies, or practices. Use third-party sites at your own risk.

13. TERMINATION

We may terminate or suspend access to the Service immediately, without notice, if you breach these Terms or misuse the Service. Upon termination, your right to use the Service will cease.

14. DISCLAIMER

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind.

We do not warrant that:

  1. the Service will be uninterrupted, secure, or available at any particular time or location;
  2. any errors or defects will be corrected;
  3. the Service is free of viruses or harmful components; or
  4. results of using the Service will meet your requirements.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by law, TORWOD LLC and its directors, employees, contractors, partners, agents, suppliers, or affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  1. your access to or use of (or inability to access or use) the Service;
  2. any conduct or content of any third party on or through the Service;
  3. any content obtained from the Service; or
  4. unauthorized access, use, or alteration of your transmissions or content.

To the fullest extent permitted by law, TORWOD’s total liability for any claim related to a purchase or the Service will not exceed the amount you paid to TORWOD for the applicable product/service giving rise to the claim in the 12 months before the event giving rise to liability.

16. INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold harmless TORWOD LLC and the Released Parties from any claims, damages, liabilities, costs, and expenses (including attorney fees) arising from your use of the Service, your violation of these Terms, your misuse of TORWOD products/services, or your participation in activities or events.

17. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law provisions.

18. SETTLEMENT OF DISPUTES

All complaints must be emailed to direct@torokhtiy.com. You agree to attempt to resolve disputes informally by contacting us before filing a claim, to the extent permitted by law.

19. CHANGES

We reserve the right to modify or replace these Terms at any time. By continuing to use the Service, you agree to be bound by the revised Terms.

This policy applies to physical merchandise purchased from TORWOD LLC (“TORWOD,” “we,” “us”) via store.torokhtiy.com or any other torokhtiy.com subdomain that sells physical goods (“Physical Products”).

Most Physical Products are made-to-order and fulfilled through our print-on-demand provider Printful. Production and shipping details may vary by product and destination and are shown on the product page and/or at checkout.

1. MADE-TO-ORDER / PRINT-ON-DEMAND

Physical Products are produced after you place an order. Because items are made to order:

  • we do not accept returns or exchanges for buyer’s remorse (e.g., “changed my mind”);
  • cancellations or changes may not be possible once production begins.
  • we do not offer size exchanges;

If you need to change your order (address, size, item), contact us immediately at direct@torokhtiy.com. If production has already started, changes may not be possible.

2. ELIGIBLE RETURNS / REFUNDS (DEFECTS, DAMAGE, MISPRINTS)

You are eligible for a replacement or refund if your item arrives:

  • damaged
  • misprinted
  • defective
  • significantly different from what you ordered due to a production error

You must report the issue within 30 days of delivery.

To file a claim, email direct@torokhtiy.com and include:

  • your order number
  • a clear description of the issue
  • clear photos (and if needed, a short video) showing the problem

If your claim is confirmed, we will provide a replacement or refund (at our choice, depending on the case and availability).

3. NOT ELIGIBLE (NO RETURNS / NO REFUNDS)

Because items are made to order, we do not offer refunds or returns for:

  • wrong size (please use the size chart on the product page)
  • buyer’s remorse / changed mind
  • normal wear and tear
  • damage caused by misuse, improper care, or washing instructions not being followed
  • minor variations that are normal for print-on-demand production (small alignment differences, slight color variation due to screen/print differences)

4. SHIPPING, DELIVERY, AND CUSTOMS

Delivery times shown at checkout are estimates. Shipping delays can occur due to carrier issues, holidays, weather, or customs processing.

International orders:

You are responsible for customs duties, taxes, and any import fees required by your country.

Customs Responsibility:

You are responsible for customs issues that may arise. If your package is held at customs, it is your responsibility to contact the customs office directly, as not all customs agencies send notifications regarding shipments. Please monitor tracking updates and address any customs matters promptly to avoid delays.

5. LOST PACKAGES / DELIVERY ISSUES

If a package is marked “delivered” but you cannot locate it, first check:

  • your delivery address and mailbox
  • neighbors/building reception
  • carrier tracking details

If you still cannot find the package, contact us at direct@torokhtiy.com within 30 days of the estimated delivery date. We will investigate with the carrier/fulfillment partner and advise next steps.

6. WRONG OR INCOMPLETE ADDRESS

You are responsible for entering a complete and correct shipping address at checkout.

If an order is returned due to an incorrect/incomplete address provided by you, additional shipping fees may apply to reship the item.

7. REFUNDS

If a refund is approved, it will be issued to the original payment method. Processing time depends on your payment provider.

8. PRINTFUL REFERENCES

1. SCOPE AND ACCEPTANCE

This Offline Events Liability Waiver (“Waiver”) applies to any in-person event, seminar, camp, workshop, meetup, training session, demonstration, or related activity (the “Event”) that is:

  • hosted, organized, or operated by TORWOD LLC (“TORWOD,” “we,” “us”), and/or
  • hosted by a third party (venue, gym, organizer, sponsor) where TORWOD or any of its coaches, staff, contractors, or representatives participate as speakers, coaches, presenters, or leaders.

By purchasing a ticket, registering, entering the Event premises, attending, participating, or observing, you agree to be bound by this Waiver.

This Waiver is in addition to TORWOD’s Agreement and Release of Liability. If there is a conflict, this Waiver controls for matters related to the Event.

2. RELEASED PARTIES

“Released Parties” include TORWOD LLC and its affiliates, related entities, brand owners, officers, directors, employees, contractors, coaches, consultants, agents, volunteers, successors, and assigns, as well as, where applicable, the Event venue, facility owners/operators, third-party organizers, sponsors, and their respective staff and agents.

3. ASSUMPTION OF RISK

You understand and acknowledge that fitness and sport activities, including weightlifting and strength training, involve inherent risks that may result in property damage, serious injury, permanent disability, illness, or death.

Risks may include, but are not limited to:

  • equipment failure or misuse (bars, plates, racks, platforms, etc.)
  • slips, trips, falls, collisions
  • improper technique, fatigue, overexertion, dehydration
  • actions of other attendees/participants
  • venue hazards (flooring, lighting, crowding, weather conditions, travel to/from the Event)
  • illness or exposure to communicable diseases

You voluntarily assume all risks (known or unknown, foreseeable or unforeseeable) related to attending, participating in, or observing the Event.

4. HEALTH, ELIGIBILITY, AND YOUR RESPONSIBILITY

You confirm you are at least 18 years old (or, if allowed by the Event, you attend only with written consent and supervision of a parent/legal guardian).

You are responsible for determining whether you are fit to participate. TORWOD recommends medical clearance from a physician before participating in any physical activity.

You agree to follow all safety instructions, venue rules, coach guidance, and Event policies. You agree not to participate if you feel unwell or if participation would be unsafe for you or others.

You confirm that any information you provide to TORWOD or Event staff (including health-related or participation-related information) is accurate, complete, and not misleading. To the fullest extent permitted by law, the Released Parties are not responsible for issues arising from inaccurate, incomplete, or omitted information you provide.

5. RELEASE OF LIABILITY / WAIVER OF CLAIMS

To the fullest extent permitted by law, you waive, release, and forever discharge the Released Parties from any and all claims, demands, causes of action, damages, liabilities, costs, or expenses (including attorney fees) arising from or related to:

  • your attendance at, participation in, or observation of the Event;
  • any injury, illness, disability, death, emotional distress, or property damage occurring in connection with the Event;
  • the actions or omissions of other participants, attendees, spectators, or third parties.

This release includes claims arising from the ordinary negligence of the Released Parties, to the fullest extent permitted by law, but does not include claims that cannot be waived under applicable law (for example, gross negligence or willful misconduct where prohibited).

6. NO GUARANTEES / EDUCATIONAL NATURE

The Event may include coaching, demonstrations, and educational guidance. You understand that:

  • results are not guaranteed;
  • any instruction is general and not individualized medical advice;
  • you remain solely responsible for how you train and what loads/variations you choose to perform.

7. PERSONAL PROPERTY

You are responsible for your personal property. The Released Parties are not responsible for lost, stolen, or damaged personal items.

8. EMERGENCY MEDICAL CARE

If you are injured or become ill, you authorize the Released Parties to seek emergency medical care for you if necessary. You understand you are responsible for any medical costs incurred.

9. MEDIA RELEASE (PHOTO/VIDEO)

The Event may be photographed or recorded. Unless you notify Event staff in writing before the Event (or at check-in) that you do not consent, you grant TORWOD a worldwide, royalty-free license to use your likeness, image, voice, and appearance captured at the Event for lawful marketing, educational, and promotional purposes, without compensation.

10. INDEMNIFICATION / HOLD HARMLESS

To the fullest extent permitted by law, you agree to indemnify and hold harmless the Released Parties from any claims, damages, liabilities, costs, or expenses (including attorney fees) arising from:

  • your actions or omissions at the Event;
  • your violation of rules, instructions, or policies;
  • your misuse of equipment or facilities;
  • claims brought by third parties related to your conduct.

11. SEVERABILITY

If any provision of this Waiver is held invalid or unenforceable, the remaining provisions remain in full force and effect.
